My concerned line manager not accepting resignation ,


I have resigned in a company after 2 years of service without serving the notice period. The notice period as per appointment letter is 3 months. My immediate boss has not accepted the same & don't want to relieve me either. On contacted HR they told first you take acceptance from your immediate boss.then we start the relieving formalities, and since i have not served the notice period ,i have to pay the 3 months salary. Please advice me for the same and suggest me the way for not paying the 3 months salary

Resignation should be addressed and supplied to appointing authority, MD preferably by redg. post.

 

Line manager and HR is not employer.

 

You may show the standing orders of the company, appointment letter to a competent and experienced labor consultant/service lawyer and submit a carefully structured representation to the good offices of the company: Appointing Authority, MD……………and cover all points so that the compnay does not take stand that abrupt termination has caused any loss............................

 

Your lawyer that has seen your docs, analyzed the inputs given by you and merits can advise you best. Your lawyer may opine to send the cheque of notice pay or to affirm to adjust notice pay in FNF statement/settlement.
