Respected lawyers kindly help me in following query. My lawyer, on my request has filed a resjudicata petition under cpc sec11 to get the divorce petion filed by my wife at her parental place,dismissed .
I have won sec 9 hma decree at our matrimonial place .
.My lawyer has mentioned in the petition that wife has filed divorce petition concealing the details of sec 9 case. Hence it is prayed that her petion may be dismissed with heavy cost.
First hearing is in next month.I want to delete these words "dismissed with heavy cost" as I do not want it . Moreover I feel it will show a revengeful attitude on my part and will go against me.
Pl. tell me the procedure to delete these words from petition . Pl.quote relevant order and rule of CPC.
