Misuse of powers by senior officers

Hello forum members,

I am a cetral governemnt employee. I just need few suggestions regarding some circumstances i am facing these days.

1) I am posted in Lucknow. I got married in November and my Husband is an IT engineer in Bangalore. After my marriage i had to go to Bangalore on Leave to stay with my husband.

2) Due to some reasons i dont want to take transfer to Bangalore because we are planning to relocate to Noida in 1-2 years. I was on earned leave n Half pay leave after my marriage till now.

3) I have completed more than 5 years in the department. Due to limited amount of earned leave in my account i applied for Extra-Ordinary Leave along with permission to travel abroad with my husband as he has to go to UK on deputation.

4) My officer rejected my leave and sent me various letters to join duties immediately and why as to disciplinary proceedings should not be initiated against me quoting my absence as unauthorised.

5) Being in Bangalore i was not able to join immediately and i came back within a month and joined back.

6) As it is a discritionary power of my DG to sanction or reject my EOL. But being in such circumstances i am not able to take transfer right now n things are not in my hands as i have to look after my family too.

7) Government policies say that u cannot claim leave as a right and on the contrary it also says that we can avail Extra ordinary leave upto 5 years if required. Then what is the need of making such provisions if a person will only grant us leave if he is understanding. Else he will only spoil the things.

I need experts guidance on what i should do n what action can be taken against that person. Can i file a complaint against him or not? Is it not my right to avail leave if circumstances are demanding so?
