Minor accident offender denying to pay compensation

Hi

A few days back i was waiting at a red signal in my car and all of a sudden another car hit my car from behind badly (at a speed of approx 50-60 KMPH). Fortunately nobody was injured in the accident however my car was damaged badly. I could bring the Police to the spot at that time and got the FIR filed in the nearest policy chauki.

After the FIR was filed, I took my car to the service station, did all documentation for insurance claim, etc and came back home. Later I got a call from the service station and they gave me an estimate of approx Rs 80,000 out of which I will have to pay around Rs 15,000 and rest will be taken care from insurance settlement.

When I called up the other person to talk about compensation for my car's damage (basically asking only for my component i.e. Rs 15,000), he mentioned that as the FIR has been registered he needs to go to court now to pay the fine and he is now denying to pay me the compensation.

What are my legal options now to get the compensation from the other person?

You can file a petition for compensation.
