Mental harassment of a government school teacher

I'm a female,working as a Science teacher for 5+ yrs in a delhi administration government school.i'm confirmed in my job.

each year teachers are ordered by edu. department to take classes in winter and summer vacations.

they have no personal life.this has made the teacher community very upset.
now atleast 2 teachers in our school are supposed to prepare time table of themselves and other teachers during holidays,ie,for the no. of days each teacher will to take classes.

both the teachers are good friends with our vice principal who trusts them a lot and supports them too.she has the habit of only listening to their side of the story.

now both teachers made time table in such a way that their own group (friends)of teachers are coming only for 2-3 days in vacations while other teachers have to come for more than 5 days.

i had requested them many times earlier to let me know the time table but they hid it.

now when holidays are starting in one day,they gave it to me immediately for signing and are not ready to reduce my days,saying that it had already been sent to directorate of education and no change can be made now.

when i complained to principal,she shouted publically and defended them by saying she made it and if i have objections,i should give in writing that i cant come for so many days.

every year these teachers make an unfair,unjust time table and always give very few days of work to themselves and their own group.

my principal even says that if i dont come for so many days,i should also arrange another teacher who will work on my behalf.otherwise i shall be given a memo.

 

now what can i do so that this unfair practice stops forever?

1. is it my duty to arrange another teacher from my school who would like to teacher on my behalf?what if other teachers refuse?because nobody is happy working in holidays.

2. if i am given a memo for not working for the full no. of days,what reply should i give so that these people never repeat this injustice again from the next year onwards?

please guide me.i want a diplomatic yet bold action from my side so that they realise they cant take me for a ride each year.

please dont ask me to compromise again this year on this issue because i did so last year also and this has made them more gutsy.

SUCH LIKE TREATMENT IS GENERALLY THERE FOR THE EMPLOYEES WHO ARE NOT DEDICATED.

It is apparent that the Principal is going professionally to create ground for making legally tenable adverse entry in ACR which will bar your promotion/ACP for 5 years.

You have been given opportunity for making a representation and did not do so and you expect diplomatic and bold action.

So far you have not stated anything which can be a cause of action or could be called atrocity.

If you are called during vacations you are given extra leaves. You cannot dictate your own timing.

If you can arrange services of another teacher from another school the Principal is willing to accommodate you (as you told). It is not at all responsibility of the Principal to arrange your substitute simply because you do not want to do your job.

She can do so. She can write to the DDE about your dereliction of duty and recommend disciplinary action and have posting of another teacher.

Whether you come or do not come in vacations, fall in result is deemed lack of performance which you have to fill you self in your ACR resume. If the Principal has a proof of your arrogance on record then further action can be taken against you.

Even if you are confirmed employee yet DDE has powers to award you minor penalty without holding inquiry which can be upto stoppage of 3 increments for three years without commutative effect.

In case the conduct (in the opinion of DDE) appears to be warranting higher punishment he/she can hold inquiry and refer the case after inquiry to Director, who is competent even to order dismissal from Service.

As Delhi Govt employee you are governed by FR/SR and rule 11 ibid clearly says that any govt employee can be deployed for any job for any no of working hours with or without remunerations.

Thanks for the lengthy replies Mr. Sudhir Kumar.

About leaves,we have no attraction.If we work for 20 days we get only 10 and not 20.We are still losing out on 10 leaves and we don't find it a very attractive proposal.

I'm not an escapist trying to avoid my duties.

I just want justice.

Why is it that a particular group of teachers get fewer days to work,whereas others have to toil hard?Dont they too have the right to rest in vacations?

This is my point of dispute.....That all teachers get eq. no. of days to work.

Is it not unjust action by the school.

one teacher(not me) who stays far is forced to come for 8 days but another one is given the relaxation to come only for 3 dys necause she stays far(and is the principal's favourite).

is there no point which i can use in my favour so that i can get justice in this regard?

Move collectively if there is injustice and take up the matter with directorate to evolve a system so that each teacher gets equal work during vacations to avoid such favourite games.  Your associations/unions may play a role in evolving a system of rotation.  Till then one has to obey the reasonable orders of superiors.  If you have worked during last vacation, you can point out the discrepancy and disproportionate victimisation as per facts on reccord and file a grievance.  There should not be discrimination as per constitution.

Sorry to point out.

 

She has not quoted which class/subject she is teaching.

 

She has also not quote dhow many hours she will attend scholdand how many days EL credit (or CH) she will get.

 

She has also not stated whether if some other teacher teaches her students in vacation and improves their result whether said teacher will or will not get credit of this result in their ACR.

You might have beenon Election duty without any credit of leave.  Your Principal chose to shout only.  But if such atttitude is shown during election duty the SDM will not at all shout and will very cooly order arrest.

 

AS FR-11 a central Govt employee which includes UT employee) is liable to work for any job whenordered for any No of hours with or without remunerations.

 

Many teachers attend many duties during vacations (i.e. extra classes/hobby/sports/NCC etc).  In 1996 I have seen all urdu medium teachers (male) of all level of all schools in Delhi called from home in vacations and airlifted to J&K for election duty. None had a choice to forfoe the incentive.

 

Even judges (who are goverened by same leave rules as you) attend office during vacations.

You can submit written complaint against th ePrincipal.  The CVC encourages govt employee to make direct complaint against Sr Officers if they find that they ar emisusing powers.

You can visit a school in Andaman and see if any teaher is travelling by boat for coming to school.

They are as good UT employees and governed by central rules.

 

You can visit any single teacher school in Himachal and Uttaranchal where teachers (equaly qualified) have to travel full day (oen way)  on foot to come to collect salary or when having other work in distt (i.e submitting ACR, applying for GPF etc) with no place to stay overnight except some dharamshala as back journey is possible only in day time through forest.

You and other employees have a right to represent against unfairness that you feel and shouting in public against you.

While you decide to represent you need to have irrefutable evidence to prove your contentions.

While you decide to agitate you must first of all download the extent service rules that apply to you and compliance by you.

Instead of jumping to agitate first of all gather evidence of bias, unfairness etc etc ……………..

It may take time but it shall be better.

 

Certainly such matters should be contested thru employee’s forums/unions; if any.

I agree with Mr Kumar Doab.  The Principal should not have shouted (even if you brought her to breaking point) as you have provided (or likely to provide) enought material to her for spoiling your career. 

 

As far as rules are concerned, the service rules applicable to UT emloyees are the same as of central employees and are available in market.

 

As far as teacehrs unions are concenred theyhave bigger issues to handle. (i.e. recently they called mass CL of teachers when one teacher was tabed to death by butcher knife for catching copying).

Irrefutable evidence only helps.

The employee that has irrefutable evidence of complinace, performance, (everything)  is better placed.

More so in cases of Head on conflicts. 

Handling the bosses is also a skill and can be acquired like any other skill.

Are you sure that soemone shall be your unshakable witness(es)!

 

Conduct and Discipline Rules are for everyone be it sub ordinate or Boss.
