Medical report as evidence for quash

Hi experts


, Need your valuable suggestions


In a marital Dispute case, the case was filed for quash.


In that case report of a doctor plays a crucial role to prove that the opposite party gave a false complaint.


A doctor’s report (from a Private hospital) of the complainant is with her Husband.


Now to prove in the court that the report belongs to her, submitting the report alone is taken into consideration or even the doctor should also be present in the court to prove that the report belongs to the complainant

Evidence will not consider in quash.. if hte medical report evidence is not sufficent or opposite party rises a query then doctor appereance needed

To prove the report , call the Doctor who examined and prepared the report, it is necessary.

The doctor's report will be produced as documentary evidence to substantiate and establish the petitioner's pleadings for quash, however if the evidence is being objected to by the respondent for marking it as exhibit due to its veracity, the burden to prove the authentication of the said document through the said doctor who is reported to have given the report can be summoned to the court to adduce evidence to prove the document.

The same is a proof and has no relevance in quashing.
