Marriage post live in relationship
I am a professional working out of Dubai, UAE. I have been in a relationship with my friend (Filipino) for the past 4 years in Dubai (since 2011) and we started living together. In 2012, she conceived and left for the Philippines to deliver the child as it is illegal to have such a relationship in UAE. We were both unsure of our relationship at that point, hence we did not get married. However, I took complete responsibility for my actions as the biological father. Our relationship went through some ups and downs and finally we have grown confident of ourselves and have now decided to get married.
The child was born in the Philippines in 2013 and continues to live there with his grand mother.
My partner moved back to UAE and started working again and we have continued our relationship. During this period, neither of us engaged in any alternate relationships. We were faithful and committed to each other even though we were unsure about getting married.
Now that we have decided to get married and also bring our child to UAE, we are contemplating if we should get married in India under the Indian Foreign Marriage Act. However, we want to understand how our child can be given legal status. He has a Philippines birth certificate where my name is registered on his birth certificate.
For us to live in UAE with our child, we want to have proper legal paperwork wherein our child and us will not encounter any problems in future in UAE as the laws of UAE do not permit live-in relationships and of course children out of wedlock.
I am seeking guidance to understand if the legal provisions in India provide for my situation and can I obtain suitable paperwork to continue living in UAE with my partner and child without legal problems.
