Maintainance after mcd

Dear respected Lawyers,

I got MCD through court, and in MOU it is written permanent alomony, no future claims on cash or property,498a will be taken back, and we paid lumpsome amount.

I came to know my wife is working for a salary of 10,000 presently.

I work abroad and i get a good salary of 2lakhs,

Is she eligible for Maintainance even after she signed the agreement.

If summons of maintainance is sent to my home address, is it necessary for me to travel India and attend the court,i am planning to buy a property also.

Please guide me, so that i will be plan carefully

The agreement puts an irrevocable seal on her further claim to maintenance. In case of summons beiong served, you need not travel personally to India. Your lawyer may represent you in the court, and bring the MOU to its notice.

Thanx Asish for your valuable guidance.

I came to know through this threads even she signed the MOU she can claim future maintainance?

If it is true, if i prove to court she is earning 10,000rs, is that enough to escape the maintainance...
