leave without permission

I am class 1 gazetted officer working in govt of nct of Delhi as medical officer. I had applied for child care leave for 15 days however last moment I had to travel out of station. Regarding intimation I gave application to my dealing clerk. When I reached my home town I received message that my application was lost. Does this amount to any misconduct as my medical superintendent has issued me a memorandum regarding this and trying to take his previous personal grudges against me. Plz provide me help in this regard. Thanks. Dr prachi

You have posted that:

How this message was received say by: SMS/email/Whatsapp/in person etc or verbal?

Do you have any evidence of having handed over the leave application? Will any of your colleague witness that you had handed over the application? Is the clerk agreeable to affirm that you had submitted the leave application and it was noted in leave register at serial number on dated?

 

As per your service rules how are you expected to submit leave application: in person with entry say in inwards register?

As per your service rules to whom you are expected to submit leave application: dealing clerk, MS?

Can you leave station without prior intimation/permission?

 

---“ my medical superintendent has issued me a memorandum regarding this’

What are the charges leveled in it: Absence without leave application or leaving station without intimation?

 

Both are misconducts.

Study your leave and service rules and you will find the answers, including these are major or minor misconducts.
