Leave at the end of deputation period

An officer whose period of deputation of 5 years is ending on 30.03.2015. Now, only 20 days to go, for him to get repatriated to his parent department. Can anyone kindly inform whether the borrowing department can sanction Earned Leave for 40 days from 11.03.2015, applied for by the officer?

Borrowing department cannot sanction leave beyond the deputation period. In other words, if sanctioned , that would be illegal extention of undue deputation, which may cause complications in regulating your service only.  The borrowing department can sanction leave only for days falling within the deputation period, but still subject to the condition that your charge handing over formalities are completed on or up to 30.03.2015. You may have to approach your parent department for sanction of additional leave beyond the date of expiry of deputation.

Yes such leave can be sanctioned.
