Kharab land in apartment complex

Recently i booked an apartment in Bangalore. During the OC verification , Engineer found there is a kharab land in the apartment complex. and as per plan that particular land is where swimming pool and basketball court coming [as now it is empty] i am not sure whether i should go ahead with the agreement because of this issue. Doubts 1: What will happen if builder constucted swimming pool and basketball court over there..? 2:In future any leagal problems we may face from government ..?
