Internet cables passing on my house

Hi, On my terace there are few cables which are attached to my building , its from ACT internet cables , No one in my property uses act , ACT didnt ask for any permission , they keep visiting my property to check the cables , Once my JIO internet cable was cut , (cant accuse them without any proof) Should I send a notice /; cut the cables

Hi, 

The cables running over your terrace without your consent amount to unauthorized use of your property. Even if they belong to ACT Internet, they are required under law to take prior permission from the property owner before laying or attaching any cables. Since you or your tenants are not consumers of ACT, their entry into your premises and regular visits to check cables can be treated as trespass under the Indian Penal Code and also as violation of your property rights under the Indian Easements Act.

You should avoid cutting the cables on your own, because if any damage is caused, they may allege obstruction of essential services or lodge a police complaint against you. The safer legal route is to serve them with a legal notice, calling upon them to immediately remove the cables from your terrace and restrain their staff from entering your property without written permission. If they fail, you can approach the civil court for injunction and damages.

This way you establish your ownership rights, put them on the defensive, and protect yourself from any counter-blame. At the same time, if there is a repeat incident like the cutting of your Jio cable, you will have stronger grounds to escalate matters legally.

Yes, you may send a legal notice and may even initiate a civil action. You can as well take up the issue with the Executive Magistrate.

By the way, what is the nature of your residence - Is it a an apartment or an independent house?
