So, if i disown my mom, my sis says she will undertk 10 lacs loan. I cn come out of all her liabilities. V both r own sisters born to same father & mother.

Pyt by my mother for interest. Noreceipts for interst paid till now. T & C is that if my mother doesnt pay principle amt, my husband will be caught, nxt will be me. Since i hv gone for divorce my husband wants my mom to arrange a different guarantor & to relieve him as such from the cases. So, now my siater is demanding me to disown my mom as she would be tkng care of my mother henceforth & her loans too.

More of less the other Lady is something like buying your share in estate of mother.

It is upto you to decide that you are getting a fair price or not.

 

It is as simple as simple that during slimp financer wants property  to be offerred by owner somewhat 25-35% less tham market price and seller shall be paid after 1 year from signing agreement to sell.

 

It is upto you to decide you T&C to relinquish your stake.

Imp: Your mother is alive. During her life time NO one has forced share.

The property as per you is under debt.

If your sister can end your financial issues then it is upto you decide it.

Prefer to show the Loan dcos to a very able local counsel of unshakable repute and integrity specializing in such/civil matters.

Only a husband or a wife can be disowned or rather divorced. There is no provision in any law to disown a mother. But if the younger sister wants, let Deepika Kumar give a declaration that she disowns her mother. The younger sister not only assumes upon herself all the liabilities but also actually clears the liabilities. The creditors would then relieve both the sisters out of the liabilities. Until then the elder sister will have no relief.

Such declaration with such language “So, now my siater is demanding me to disown my mom”

May not necessarily have any legal force in it, as far relinquishment of share in Mother’s proeprty is concerned……………………as property seems to be self earned/acquired/absolute in the hands of Mother……………………..and mother is alive.

Succession opens on date of death of owner.

Legal heirs/successors have a share if owner deceased without disposing the property in his/her life time by a valid/registered deed.

The younger sister/borrower/guarantor may obtain current loan statement with seal and signature (full amount: Principle+interest-amounts paid=current balance ) obtain hard and soft copy, may pay the loan as per current statement by cheque under proper acknowledgment, obtain latest statement showing full payment
,NOC/NDC, obtain original property docs, latest encumberance report, and close the matter.

Thereafter it is felt that younger sister would want to obtain a valid/registered deed say: gift/WILL from mother.

It is between Mother, and her sons/daughters.

 

You want to be relieved from the situation , you may decide what is best in your interest.

Once you are relieved try to make up with your husband and try to save your marriage.

 

Try to find some job and be financially independent.

 

You shall have share in estate/property of Father/Granny and Mother that is left undisposed by them their  life time by a valid/registered deed.
