Any one can obtain legal heir certificate, and it is the duty of authorities to inquire and give such legal heir certificate as per norms.  The certificate must state all legal heirs but simply getting a legal heir certificate is not enough, as to how she acquired her property is important.  If that property was acquired by step mother from her maternal home, then step son may become legal heir but may not be class 1.
