Gram Sabha Land

Sir,
Can a Trust /NGO use gram Sabha land for opening of a school in a rural village.
And what is the procedure to took the land in appropriate manner. So that in future there should not be any dispute.

The government has issued a circular making it mandatory for managements planning to open private schools to own a minimum of two acres of land in rural areas,The government will not accept applications unless copies of land ownership papers or the agreement of the lease period is affixed before submitting.This is to ensure that children get sufficient space for sports activities on the school premises.

The government has also made it mandatory for schools to have at least five classrooms for primary section, eight classrooms for higher primary, and nine classrooms for high schools — all measuring 18ft X 20ft.

Each school should have a minimum of eight toilets for boys and girls, apart from drinking water supply.

The decision of the Gram Panchayat may have to be endorsed by state govt.

Let the counsel of the trust opine by providing legal opinion in writing after examining the state govt rules e.g;

The Punjab Village Common Lands (Regulation) Rules, 1964; 3

The Punjab Village Common Lands Regulation Act 1961 Punjab Act No. 18 of 1961;3

You may also try to ascertain from O/o Authority e.g; Collector Office

You may take help of elders of your family, competent and experienced well wishers, seasoned PIP’s, helpgroups, community leaders, NGO’s, experienced colleagues, associations, etc to resolve the matter if any, and/or find a very able LOCAL counsel specializing in concerned filed of law e.g; Revenue/Trust/Civil matters as in your case, and well versed with LOCAL applicable rules, revenue codes/rules, precedence, latest judgments etc …. and worth his/her salt, can advise you and even help you.

Online discussions are not substitute to in person discussions with a very able counsel of unshakable repute and integrity specializing in concerned field of law.
