Threats to withdraw a case under section 138

Threats to withdraw a Case under Section 138

In a Section 138 NIA case, the accused, a powerful person and a relative of a very Senior Police Officer & a High Court Judge threatens the complainant to withdraw the case filed against him or face the consequence

What is the proper course of action with the complainant?

Should this be brought to the knowledge of the Court? If Yes what should be the prayer to the court? The fact is that he even threatened tehCourt and the Court remained a silent spectator!

Theoretically it is easy to suggest to file an Fir against him but given the fact of his status the Police will not easily take any action against him. So how to deal with this?

Whom so ever may be. All are equal under the law. If threatens comes record the same with the help of communications providers such as AIRTEL, BSNL, etc. and submit the same with the local police station & obtain F.I.R.copy.
