i propose to purchase a readymade house at Puri Odisha but the owner of the property has taken a Hosing Loan from a nationalised Bank hence he wants first to repay the entire House loan dues then & then pay the difference amount which takes to consider in saledeed.
I want to repay the proceed amount through Housing Loan but my problem is that first i have to pay the Bank dues on agreement basis and after the release of the mortgage documents by the Bank then i can register the documents in my name but since the thing is to be done through agreement basis ,i want to secure myself for the amount paid to the bank for their dues through any deed which can legally enforcable or bind the owner to does the thing in time.
