498a filed twice

My wife filed 498a (dp3 & dp4)(FIR NO 216/2012) in state of Andhra Pradesh(Nellore) which is her native place. six months later she filed 498a,324,506(FIR NO 137/2012) at my place Andhra Pradesh(Kavali). we got bails in both the cases. charge sheet has not been filed in both the cases.

                My question is is it possible to quash the second false case without the charge sheet. we have a evidence to prove the above cases are false.

is it compulsory that charge sheet must be filled for quashing?

additionally, can the victim file malicious prosecution case since second 498a is clearly malicious? this way instead of waiting for acquittal on the first 498a and then going for counter, he can take some advantage of this second 498a.
