Shall I file 9 hma to avoid 498a. But I don't want her back

there is no hard and fast rule to file a petition under section 9 of HMA act.

Sometimes, it has to be filed , to weaken her stand in the case.

Instaed of that, engage a preffessional lawyer who is expert in these type of matters ie., [498a matters]

If you filed you can defend the case if 498A is filed.  It doesn't make much difference.

If you do not want to reconciliation so there is no benefit to file a suit for RCR ,this suit can not defend the case against the 498a IPC,rather you can wait or you can file a Divorce Suit.

Nope, no use, if you dont want her or dont want 498a. If sufficient ground exists, press for divorce
