Quashing the dv case when it is in mm court

As said earlier -- My bro wife is residing at one part of premises. The premises is owned by me. My bro and his wife has some family dispute and living separately and wife filed a DV case against him and included me and my wife also in the respondents. I have filed a civil suit to evacuate them.

Now the matter ( of 2011)  is in MM court and no order or interim has been passed. Now at this stage can I go for quash in High court  as now I learn that I have no domestic relationship with her.

kindly see the definition of domestic relationship.....she is residing in ur premises, then how u can say that u r not in domestic relationship
