I have been living in a house for last 25 years which was on my mother's name
My brother through my mother's registered power of attorney issued to him to sell the house had sold off the house 13 years ago in 2005 which is still occupied by me and the owner legally has not claimed the house till now but retorting to illegal means of selling it or getting it vacated.
My mother passed away in 2012.
Further After seeing the copy of registered PoA issued to my brother by my mother to sell the house on her behalf in 2005, the house number mentioned in the PoA document states 478 everywhere whereas the actual house number is 178 and not 478.
During the transfer of papers and new registration of the house to the new owner,I had been shown as a Licensee occupying (kabza) half of the house by the consent in the new registration deed. In the registry it is shown that we occupying 50% of the house but actually we are occupying the whole house.
We have never paid or have been demanded any rent by the owner ever and there is no other lease or rent or license agreement. There is only one electricity and water connection which is still not on the new owner's name.
As we are having exclusive possession since last 13 years even after the new owner registered it on its name is it a case of adverse possession, though he showed us as licensee in the title deed?
We have carried a lot of permanent nature of work like maintenance of the house like paints, woodwork, maintenance,payment of electricity and water bills etc. Is any legal way out to challenge the deed of house based on the above facts. Any help will be highly appreciated.
