Hi Advocate/Expert,
I am working as a Project Manager at Navi Mumbai for IT firm which is US based company run by indians (3 brothers) and started operation here since last 3 years. I resigned the company on 18 March 11 by sending a mail to all 3 owners as they are based in USA. None of them acknowledge the mail for days. I send multiples mails requesting them to settle down my final settlement & pay my salary of Feb 11 & Mar 11. But none of them replied. I tried to reach them on chat, face book after which they replied that they will settle it and started creating unnessary delays by raising queries and saying that it is looked by other person etc. Its for one month they played this game and atlast again stopped communication. I cannot catch them since they are in US and the office here is closed now. I know their residense address (given on rent) and care taker ( power of attorney) who makes all cheque payments.
I want to make them talk and file suit on below points
1) Not cleared by Final settlement
2) Not provided me with relieving letter & experience certificate without which i am not able to get job
3) As per agreement there as to be 1 month notice or pay in leiu by either. Since i resigned on 1 Mar 11 none of them acknowledge the mail or communicated with me so i stopped going office but was trying to reach them on mail, phone, chat to discuss on relieving procedure . They have to pay salary of April 11 also along with Mar 11, Feb11?
