Marriage Under Special Marriage Act, 2006
(1) Daughter :- date of Birth 2007
On the day of Boubhat ceremony at “Phulashajya” night the Husband notice short of illness in the behavior of the wife and on asking the wife deny the same and told the husband that she is fine. After marriage they started their happy conjugal life but the husband and his parents notice that although the wife took part in every day to day work but she always live within an anxiety, his parent ask the wife about the same she tried to avoid them by making any excuse.
After birth of the female baby there was a dramatic change in the behavior of wife, in time or out of time she started become furious over the husband and his family member in any issue without any reasonable cause. If the Husband or his parent tried to variants of the wife regarding her behavior towards the child, she started to threaten them that she will commit suicide and frequently by calling her mother she went to her paternal house with minor child by making an excuse.
It is also required to be mention here that on 27/5/12 Husband made a GDE for the cruel behavior of wife.
It is also required to be mention here that :-
(a) on 2007 she have tried to suicide (cut her wrist) and write a suicide note that “no one will be responsible for my suicide”.
(b) on 2013 she have tried to suicide (cut her wrist).
(c) on 14.02.2014 she have tried to suicide (Hanging on Ceiling Fan in front of Daughter, husband and all member’s of household Member ).
It is also need to be mention here that whenever the husband told the wife that she is required to meet a doctor as her physical and mental condition is deteriorating, she went to her paternal house by making an excuse. When husband get chance to contact over telephone with the mother of the wife or her family member and convey the mental condition of the wife, the mother of the wife and her family member tried to avoid the matter and give advice to the husband to become relax in this issue.
That as the situation become more and more unendurable the Husband manage to took the wife to the general physician. After through check-up as per symptoms of the wife doctor referred the wife to a Psychiatrist specialist. As per Psychiatrist prescriptttttttion a “Phychometry Test” of the wife was also being done, report show that she is mentally retarded, aggressive and assaultive behavior..
On 29/10/13 the mother of the wife come to the house of the Husband along with the elder sister-in-law of the wife and took the wife and her female child with them, saying that she want to took the wife for few days to her paternal house for her better treatment but surprisingly at that time the wife took all her belonging and ornaments with her and till then the wife leaving at her paternal house along with the minor child. The Husband try to bring her back along with the minor child but the wife refuse to return to her maternal house. Without inform husband her Family members took her to hospital for psychiatric treatment.
After that Husband filed rcr section 9 hindue marriage act.
Surprisingly on december 2013 wife and her relatives come with 3 Police officer of local PS and verbally false complain to police against husband that husband torture mentally and bit her. After investigation police understand the trough that wife is mental patient and told to solve the problem by relatives.
After that wife stay marital house and frequently threatened husband and his parents that she will go police for written complain without any reasonable cause. Though during this time husband took her to PG hospital “Psychiatry” departments for treatment.
On Feb. 2014 without any reasonable cause wife told her husband in presence of her daughter that She will kill the Husband by mixing poison in Tea and after that She try to Hang on Ceiling Fan, but fortunately she was not successful due to her husband and relatives awareness. On same day evening the brothers of the wife come to the house after came to know the incident by her Husband and took the wife to her paternal house.
2 hearing Court completed but no one presents from Wife side. How to get divorce at this Situation. Do I need continue RCR case or file Divorce mentioning wife cruelty ?
