Father in laws rights over sale of property

Dear Sir...

Due to Maritral Issues between my borther and borther wife, my brother has gone for seeking divorce in Family court,  both are not spend a single day after the marriage in my father's house adn they got separated day one of the marriage.

She issued a legal notice informing that the entire family members are harrasing her to bring dowry of 50 Lacs, for that legal notice my brother has not replied, she also put the objection for the petition which my borther filed for divorce in Family court and regularly she also attended the Case.

After 9 Months of marraige My brother wife tresspassed my father's house, when they are not in station and for that police also supported her to stay in my father house, no complaints are accepted by Police station, in turn they thretened us for filing FIR (498a and DV Case against whole family members).

once she tresspassed my father house, she has not allowed my father and mother to stay in that house and also she sold some items in OLX also.

now its almost 2 years she alone staying their, is it possiblel that my father can  sell this property (presently she is staying in that house), is there any problem to sell this property, 50 % is SOP and 50 % Ancestral property.

all member of the family are ready to sign for selling the property.

Hope you have evidence of ' she sold some items in OLX also.'

If police is not accepting complaint send email/fax to SHO, ACP,DCP,Commissioner.

Meet senior officials and get the diary number on copy of your cmplaints.

She has not forced share in Self acquired property of Father in Law.

You may also ask your counsel about The Marriage Laws (Amendment) Bill.

The counsel that you engage/consult can update you and give considered opinion on every point/document/input you give.

Since the property is partly ancestral as a son you also have share in the property. in that case your parents cant evict her nor obtain a stay against her from entering the premises.both these things can be done only if you dont have any claim over the property.on the other hand she cant push your parents out of the house also.now dv case can be filed by mother over her daughter in law also.as far as the threatenings to file criminal cases are concerned record all her threatenings and keep it as a proof which can be used later.also file an nc in the police station that your wife might file false cases over you.

first of all stand corrected.

she is not a tresspasser.

now your family is liable to provide her another accommodation.
