family parition

 

Dear Sir,

My grand father died in 1990. In 1991 all uncle (two) and my father made a partition paper (MOU) in plain paper along with their signature in presence of one relative his signature is also in that paper.

In 1993 my eldest uncle died. After his death their children is denying from that partition.

All lands are in the name of our uncles. My grandfather has a big shop. My father was in Bank service.

Only once we got bataidari from agricultural land of ten years.

 

Now eldest uncle’s sons are threatening also.

My question is does MOU signed by our uncle and my father have any relevance in court.

What step i have to take to get preoper partition paper in our name.

when there was an agreement of partition between your father and uncle and the partition was acted upon it amounts to once parition always paritition.

If your uncle's sons are causing obstrtuctions to your father for the peaceful enjoyment of his share, then he has to file declaration and injunction on the basis of the MOU
