False schizophrenia diagnosis, denial of rights, and harassment by family — seeking legal action and

Hello respected members,

 

I am Kapil Kanchan Pandit, a mechanical engineer from Pune with 19 years of professional experience. I am reaching out to seek legal guidance regarding a grave injustice I have suffered.

 

I was wrongly diagnosed with schizophrenia by a psychiatrist, and this false diagnosis has led to denial of health insurance, employment opportunities, and housing rights. This has caused immense mental suffering, social humiliation, and loss of dignity.

 

I am already fighting a case against the psychiatrist for professional misconduct and false diagnosis, but justice has not been served yet.

 

Adding to this pain, I believe that my sister, Deepti Vinay Joshi, and both my aunts are the main culprits behind spreading this false narrative. They have continuously interfered in my personal life under the pretext of "correcting my bad habits" — yet they themselves have done nothing meaningful or socially responsible in society. Their only intent seems to be to defame and control me, not to help or reform.

 

I wish to take legal action against:

 

The psychiatrist for false medical certification and defamation.

 

My relatives for mental harassment, defamation, and violation of my right to live with dignity.

 

The insurance company for denying my rightful coverage based on an unverified mental health label.

 

 

I request guidance from legal experts on the following:

 

1. Remedies available under the Mental Healthcare Act, 2017 and Indian Penal Code for false psychiatric diagnosis and defamation.

 

 

2. Whether I can approach the State Medical Council, NHRC, or Consumer Forum for justice and compensation.

 

 

3. The best way to combine my family’s mental harassment with the ongoing case against the psychiatrist.

 

 

 

I believe that those who try to control or "correct" others should first look at their own contributions to society before judging or destroying someone’s career and reputation.

 

Kindly advise on the most effective legal path forward.

Since multiple queries have been raised/ sought in this post, it would be better to seek professional advise from a local prudent lawyer.

There is no way in which the proposed actions against the alleged wrong doing by your relatives  could be combined with the ongoing action against the psychiatrist. As regards the insurance company, they might be relying the psychiatrist's report.

Dear Adv. P venu,

 

With due respect, I would like to clarify that the situation involves deep-rooted nepotism. My aunt is a psychologist, and Deepti — along with her father, who is also a doctor — had recommended me to him back in 2005. None of them had any understanding of my background in mechanical engineering, and their interference has caused long-term harm to my career and reputation.

 

Their intent was to “correct” what they called my bad habits, but Deepti’s father behaved unprofessionally — on one occasion even bringing alcohol into his home and shouting at family members. His conduct and attitude have severely affected my life and mental well-being.

 

He destroyed my dream of becoming a doctor, telling me it was impossible because I belong to an open caste and come from a humble background — with a deaf and mute father (only 5th standard educated) and a homemaker mother (9th standard pass).

 

If there is truly any concern about my mental health, I request your help in obtaining a disability certificate through an independent government medical board, so that an unbiased assessment can finally determine the truth.

The query is very lengthy, you can briefly state the problems you are facing, as it is you have already initiated leal ation against the psychiatrist  hence you can wait for the outcome.
