False dowry case

My name is XXXXX, I'm 28 year old working in one the MNC in Mumbai In the 26 January of this year I got engaged (ROKA) with a girl. Girl is from Bhopal MP. She has done 12th and doing Diploma in Nursing. My family has been introduced on 20th Oct in Bhopal to bride family by a Lady mediator who is a relative of girl’s family and also belongs to my native place UP. After conversation between two families the marriage was fixed. Both the family wants extra time for fixing marriage date since girl was completing her education and I was planning to buy Home so marriage was Postponed by 1.5 year and date was fixed as 11th May. To confirm the marriage Roka (Varaksha) was done on 26 April 2016 at my Native place Gorakhpur UP at my expense, the approximate expense was 1 Lac INR. They had given us 21000 Cash as Sagun on Roka and gifts not more than 5000 Rs. In last 1 year period while to talking to girl I never find that she was at all interested in me OR in this marriage. Here are some reasons • Whenever I had called she always shown that see is busy with some other task and hang the phone saying she will call me back but it never happen • She had called me 5-6 times in whole year, Mortally I was the one who was calling her to build our relationship more robust but unfortunately it never happen • I went two times Bhopal at her birthday and Valentine day to just surprised her and make her happy, but after reaching there I realized Girls and her family was not happy at my Visit. I reached Bhopal on 14th Feb 2016 in early morning 3 AM and I had informed that I will meet you on valentine but she came at 12 PM, This shows that she was not eateries to meet me. I was quite and was compromising with all these things just thought that its part of arrange marriage and everything will be OK after marriage We are asking them for Engagement but in start they were not ready as her father says that it has never been celebrated engagement ceremony in his family. But after some pressure from my family there were ready. We had asked them that engagement ceremony will be celebrate in Mumbai but they were not ready saying that our all relatives are in Bhopal and they will not be able to travel Bhopal. So my Family was agreed to have engagement ceremony in Bhopal since we had less relative to will be attending the engagement ceremony. The engagement was fixed on 26th Jan 2017 in morning 11.30 AM , accordingly we had done Ticket reservation for both the side but before 7 days his father called and said that now there will celebrate engagement at 9 PM so I had canceled all 11 returning ticket from Bhopal to Mumbai due to sudden timing change. We were not clear about why he has suddenly changed the time but after reaching Bhopal we came to know that Her father was retired from his government job and given the combined party of retirement along with Engagement to his relative and Friend. Her father had done the arrangement of our stay in a hotel for one day; we were 18 people including my family and relatives who has visited Bhopal. It has cost them approximate 12000 Rs because it was just stay without food. After 3 month of engagement mediator has informed us about a strange epic which finally lead to break the marriage. She said that she was getting call from unknown number saying that boy is already married and you are doing wrong of arranging remarriage of a married person. We had informed about this nonsense to girls family and they started questioning to us and they doubt on my characteristics which was very disappointing to me. After a few days Girls’ father said that she is also getting call from an unknown number stating same story as mediator. His father visited Mumbai on 12th April and we had discussion on this matter with him along with relatives from both the side. We had requested them to postpone the marriage for next 3-4 month and once everything will be clear as why unknown caller was making call, what the purpose or motive h has? Does the caller belong from our side from girl’s side? We said we will proceed for marriage once everything will be clear. Since I don’t want to go for marriage having doubt on each other. But they were never ready for this and started threatening us that if this marriage will not happen on 26th May then they will file case against us of dowry and sent whole family into jail After all these instances I was forced to think that • Am I marring to right girl as she don’t have any emotions for me • Is Girls family is the right for me and my family since her father always disagreed with our all decision starting from engagement date to marriage date and rituals to be performed • Is the girl is having affair with some else? that is why Unknown caller want to break this marriage • Should I marry to this girl?? His father has lodged an FIR in Bhopal on 28th April in Mahila Police Station at Bhopal under section 3, 4 under dowry prevention act. Bhopal Mahila police has sent the police to my house Bhandup, Mumbai Along with Notice stating that My mother, father and me need to be present in Mahila Police station, Bhopal on 11 July 2017 else strict action will be taken by them. While talking to police officer I came to that his father wants us to repay the expenditure of Rs 10 Lac which he claim that he has spent. Now please advise us what to do next • Should I go far settlement for out of court? But I don’t have 10 Lac to pay and also it is not justifiable since his father has given combined party and we were only 18 people in the engagement from my side. • Should I file case against him for my defame? • Do I need to go Bhopal? Is it compulsory? Can I get anticipatory bail from Mumbai without going Bhopal? • How soon can I came out with all the situation since I am a working professional who don’t have time to making round in court. Pease suggest me at earliest.
