ESI contribution

Dear all members,

could u pls. anwer my query:

There is an agreement between the Principal employer and contractor but for some of portion it was alloted to another contractor(sub-contractor as agreed by the principal contractor) but as regards the contribution part  it is being deducted by the Principal Employer from the Contractor not from the Sub contractor.

 would it be sufficient that sub-contractor writes in writing stating that i will reimburse that amount which is being deducted as regards the ESI contribution.

another issue is when the Inspector comes and check the record of ESI contribution would it be sufficient that there are deductions made by the principal employers.

Suggest/advise in this regard.

Dear Satish ji, 1) The contractors should have ESI number 2) Either of the contractors should remit the ESI in their respective numbers 3) If the contractors are not remited , the principl employer is lyable to pay the amount for their workmen. Regards, PBS KUMAR
