Encroachment issue

Eminent Law Brains,

I am Posting this on behalf of my Father

My Grandfather(Passed Away) has two Sons, 1 from my First GM(Passed Away) and My uncle from next one(Alive) and 3 Daughter in total , 2 from First Grandmother and 1 from Next one.

The 6 Agriculture land  which has now with the consent of all daughters have been transferred in the name of my dad and uncle, this has been sorted out.

Now our residential property(Some Of plots),which happens to be in village falls in lal lakeer/lal dora , dosen;t have any registry claims/docs, now one of our plots which was by agreement the property of both my dad & uncle has been illegally acquired via construction of shops by my uncle without my father's consent in his absence, and now even after a lot of disscusstion he is not wiling to give  us any share in the shops, in response to it we did call for an panchayat and they ruled in favour of us and given us written ruling of their's with signing of all the witness and all.

1 So what are my legal rights in this?

2: Do we stand a chance of winning if we were to file a suit in court?

3: Does this property also have shares for my grandfather's daughter?

4: My Father's Sisters ( All 3) are threatening us that if we file a suit, they would take their share of agricultural land back already registered and intekal done, if we were to file a court case against my uncle's, is this possible??

5: My father is employed with Indian Air Force and currently posted in Chandigarh, can we purse the case via Air Force?

Please Advice!!!

Regards,

Amit Sharma
