Employer is trying to let me go before my notice period without pay.

I've been working with a company for more than a year now. After resignation on 6th march, my HR tells me that they have plans to let me go without allowing me to serve my two months notice. Can a company do that without giving compensation? All my projects have been of good quality. I fear that my employer will try to put in false allegations and try to let me go. They have a habit of harassing everyone who has resigned. 

My Employment agreement states :

In the event of termination of employment of the Employee by the Company
under Clause 9.2, the Company would make all payments due to the Employee
up to the Employee’s last working day, less any amounts due from the
Employee to the Company, including all applicable statutory payments, by
way of transfer of such amounts to the bank account designated by the
Employee or by way of issue of cheque in favour of the Employee, and such
payments shall be deemed to be a discharge of all liabilities and obligations of
the Company towards the Employee and the Employee shall not be entitled to
claim any further amounts from the Company.
9.4 Termination by Employee: The Employee shall be considered to have
voluntarily terminated this Agreement if he absents himself without leave or
remains absent beyond the period of leave originally granted or subsequently
extended, unless:
(a) the Employee returns to work within 7 (seven) days from the
commencement of such absence; and
(b) Gives a satisfactory explanation to the Company regarding such
absence.

9.5 Termination for Convenience: Notwithstanding the aforesaid but subject to
Clause 2.2, the Company may terminate this Agreement by giving 1 (one)
month notice or salary in lieu of such notice, and the Employee may terminate
this Agreement by giving 2 (two) months’ notice or salary in lieu of such
notice. However, in the event of termination of this Agreement by the
Employee, the Company may either (i) continue the Employee’s employment
through the notice period or (ii) terminate this Agreement and the Employee’s
employment, without payment in lieu of the notice period. Further, during the
notice period, the Company may require the Employee to perform only
specific tasks or may require the Employee not to attend work during all or
part of the notice period. In addition, the Company may instruct the Employee
not to communicate with suppliers, clients, investors, employees, agents,
trustees or representatives of the Company.
9.6 Upon termination for a reason set forth in Clauses 9.4 or 9.5, the Company
will be obligated to pay only the Employee’s then applicable Remuneration
(based on the number of days actually worked) through the date of termination
and any payments under employee benefit plans required to be provided by the
Company to the Employee pursuant to applicable law, and the Employee shall
not be entitled to any other salary, compensation or benefit from the Company
thereafter.

If the Company opts to relieve you immediately, it has every legal right to do so.  You do not have any case.

Notice period/pay, rate of notice pay is part of service conditions and governed by various enactments applicable to establishment/employer/employee……

The applicable enactments/statue/instrument of law shall prevail upon any private agreement/rules/policy etc  drafted by employer and signed with employee..  

Then there are judicial pronouncements in service jurisprudence even by apex court that resignation cannot be accepted before expiry of notice period…

IT is discretion of employee to ask employer to let serve the notice period or accept notice pay in lieu of notice period…

Although company has inserted IT can relieve before expiry of notice period IT has also inserted to be on safer side in IT’s own language………… inserted as per laws………….for a private interpretation as and when required…

It is practice to use deflectory language that employees that are not properly informed are unable to understand on their own…

The contract of employment should promote equitable discretions.

The contract crafted by your employer and/or IT’s attroney’s in HR/Legal cells and/or Lawyer/Law firm does not promote equitable discretions…

 

While posting such queries employee should post basic information!

What is this establishment; Govt/private/PSU……Commercial, Industrial?

What is its nature of business say; IT, ITeS?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state? Since how many months you are working?

Are you under probation period or your service is confirmed in writing?

Does offer/appointment letter/contract of employment state that notice pay in lieu of notice period is not accepted?

Which is fixed pay day? Has salary not been paid on pay day?

Has salary slip been issued and supplied? What is monthly salary?

Has company issued any notice on closure of company?

Do standing orders (model/certified) apply to establishment and your designation? What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Was ever any stinker, memo, show cause notice on any misconduct issued to you? Does the establishment have its appraisal system? Do you have copy of signed appraisal forms, matrix, KRA’s, performance date?

How was your performance? Are you a member of employee’s/trade unions?

What are the work hours?

How many hours a day you are made to work?

Is any OT paid, compensatory off given?

Do you get full off days/holidays or you are made to work on these days also?

 

Are you in PIP?

 

Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card, correct FnF statement, Form 16 as per correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?

Pl. say straight, ready to use answer, instead of meaningless big winding text, whether the Company can relieve a person, immediately, without insisting on NOTICE PERIOD OR NOT?

Let us keep the question and answer silly simple.
