Dear Experts .
I resigned from a company on 28 Feb which was having notice period of 3 months . The new company in which i joined gave me the buy out option and so out of 3 months , i served 43 days and joined the new organization .
In my FnF letter my salary of 47 days has been deducted which is equal to around 40k . Also i received 27k as encashment of earned leaves .
The buy out amount which new organization is giving me 40k -27k == 13k . i.e they are subtracting my earned leaves from the amount of salary deducted .
I had many discussions with the HR on this but they are telling me that they are having policy like this that in buy out option they always take earned leaves of previous organization into consideration . Before joining i also told them that my one and a half month salary will be deducted so will u people give me buy out option and i was confirmed for the same and was not told of this earned leaves thing .
Request all experts to please let me know as per law how buy out option is calculated because as per my understanding it is simple the amount of money deducted from previous organization , new organization will pay . And if this is the case then what i can do to take my money from employer
