Employer case

My wife employer have filed a petition on her in CMM court in the sections 403, 405, 406, 408, 43(a,b,d,e,f,g,h,i,j) and 65 and 66. The problem is charges are framed by his lawyer and he says he doesnt know what it is in it. After we have talked the company MD he directed to withdraw the petition to his lawyer. But his lawyer in last two proceedings didnt direct the company MD correctly and he is saying first wee need to sign a settlement aggrement which he would put forward to the judge for withdrawl. The question I have is....whether that person can withdraw the private petition he filed any time or we have to wait for the next day of hearing....if we can file anytime what is the process ..i would be very eager to know the answer...please suggest.
