Divorce before 1 year of marriage

DEAR MEMBERS,

CAN DIVORCE BE FILED WITHIN 1 YEAR OF MARRIAGE? THE HUSBAND IS IMPOTENT AND CRUEL, WIFE IS DOING B.D.S. IS THIS A VALID GROUND TO WAIVE THE PERIOD OF 1 YEAR SHOWING EDUCATION GROUNDS. IS THERE ANY CASE LAWS? KINDLY GIVE YOUR VIEWS. VERY URGENT........

You can file a petition for annulment of marriage(not divorce) for nullity ground that the marriage was not consummated as per provission of Hindu Marrriage Act as well as Special Marriage Act. within one year of marriage.

If the husband is impotent, you can file for nullity, no need to file divorce.
