is above statement of judges on record ?
later on the CJI clarified in a function at Chandigarh that above statement is personal view of judge and not the verdict of court..
Pls also see, "Realist theory" thread at this forum which I had posted on the day when above news was published.
Shree, thank you for posting this amusing version of the Apex Court.
Shree, thank you for posting this alert version of the Apex Court...thank you very much
It is most unfortunate that our judges, especially supreme court judges have been commenting on each and every thing under the Sun. They may be experts in law, legal interepretations of statutes, they have super expert talents in any one or some particular branches of the law, undoubtedly they are omnipotent but they are not omniscient (knownledge on every thing). They must be discreet while passing remarks in the courts on the issues which have social bearings.
In India, from centuries woman's position is vulnerable. In modern times, she is more and more projected as a "s*xual object". Stringent rape laws are not providing any relief to the vulnerable women. Just 16 kms. away from the Supreme Court, 60 days back, 18 year M.B.A. girl student has been gang raped by about 12 village neo-rich boys and the elders of the village defended their boys by saying it is a mere "rape", as if it were nothing serious. One old lady from the same village commented that the city girl has been taught proper lesson by village boys. Honour killings are rampant in and around Delhi. The capital city, where S.C. is sitting has become notorious as "rape city". The city civil courts are entertaining the applications of rape victims that they would marry the accused and they would withdraw the charges.
This is only a portion of the story of "indian woman". How disheartening to hear such comments for their lordships in Supreme Court about women. It is better for them to write bollywood scripts for comedy films portraying the woman as wamp and the man as innocent victim.
there is force in mr prabhakar's statements.
Courts are no more work as protection centers to give justice and protect innocent people - that's why still "innocent indian women" are abused by the society for "centuries" (Read with Mr. Prabhakar's message second paragraph)
After all courts are just another "typical indian government office" - don't be surprised to hear such comments from the SC (read with Mr. Prabhakar's first paragraph).
