mutual divorce questions


My wife & me applied for mutual divorce, now we want continue the marriage.
Is there any consequences if we both parties not attending for further hearing.

If you don't appear the case the petition will be dismissed no problem.

1. There will be no consequence for your not attending the hearing of your said MCD petition which will be rejected after 18 months from the date of its filing automatically.

 

2. Alternatively, both of you can appear before the Court and submit a joint  application  for withdrawal of the said MCD petition.

Hello,

Yes you can, you could choose not to attend the hearing or I suggest its better you withdraw your petition 

Without court order, marriage cannot be assumed void except conditions given in sec 5 (i),(iv),(v) Of Hindu Marriage Act

All you need to do to withdraw is file a withdrawal application before Court or appear before on the next date of hearing and inform the Judge of your decision.

I married but I again marry to another women without divorce of 1st marriage now I need divorce second marriage.

1. This fact you have not divulged in your initial query.

 

2. Your second marriage is illegal hence invalid ab-initio and a charge of bigamy can be brought by your first and/or second wife.
