Crpc 91 petition to avoid mantenance in dvc and crpc-125

Hi All, If any received summons either in CrPC-125 or DVC to appeat in court in which Interim Application is field .... is it advisable to file CrPC-91 petition seeking below things from wife:

 

1. Wife Bank statement from last 3 years.

2. Wife LIC and Other savings supporting documents.

3. Wife current earnings monthly and also the sources of income to wife.

4. Whife last workings experiene certifaicte.

5. Docuemnts in support of Husband salary.

6. Materials in support of alleged allegations, if any.

7. Wife monthly expenses list prior and after marriage.

8. Wifes ancestors propeerties and income from those properties.

 

What all you guys say..... if this petition is not filed on the day of attending the court then please let me know why?

You may add below: 9. Material that show the reasons for wife not working now.... 10. Material that show wife refused to take job offer arranged by husband.

Depends on which state the case is in.

 

In Delhi these documents would be produced by both parties before deciding the quantum of maintenance as per the rule laid down by Delhi High Court in "Puneet Kaur" judgement.

 

w.r.t. other states, you may ask partial information u/s 91 CrPC. however you can not ask information which is in your domain knowledge from her.
