What are the facts of the case

If the Consumer can  "JUSTIFY" with appropriate documentary evidences like  Bills of adjoining (nearby) Hospitals and Doctors, in similar service factor and qualifty factor, alongwith electricity bills, nurses & staff salary, water consumptions, qualfications & experiences of the doctor, stay in hospital for same similar diseases and treatment durations for the same, available'ity of the medical equipments (oxygen, Xray, Scan ...) in this hospital and other hospitals and average consumer rates for the same.

then the consumer can definetly approach the Consumer Courts and other forums for such  "white-collar exhortions".  Approach the area Medical councils and Health Ministries (under the RTI Act) and obtain current and archieved informations for analysis and comparisions before file in the Consumer Courts.  There are other factors that would have to be investifated and documentary reports prepared for submission to the courts.

i dont think the Pb, govt has fixed any maximum chargeable fee in this context.

Yes, action can be taken against the doctor befor the Consumer Court. But the only point worth considering is that you need to prvoe that the doctors had chaged extra for his services. I may mention here that each and every clinician may charge differentially for his services based on his qualification/ experience/infrastructure etc. A health care centre may have its own schedule of tariff.

 IT  WILL   BE  VERY  DIFFICULT  FOR  YOU  TO  PROVE   IN  THE  CONSUMER COURT.  MORE  OVER   YOU    CAN   NOT  GUIDE    A  DOCTOR  THAT  WHAT  FEE  HE   WILL   CHARGE  YOU?  IF   THERE   WAS  A   DEFICIENCY   OF  SERVICE   THEN  YOU  CAN   KNOCK  DOOR   OF  THE  CONSUMER  COURT  FOR  RELIEF.
