Successfully fighting with 498 (MANAGER)     30 January 2013

Dear All,

My wife filled 498a case on me at X Place.

As per FIR Crime was committed at Y,Z Places but marriage was done at X Place.

charge sheet was filled based on crime commited at place Y.

Is it possible to file quash based jurisdiction.

YES,Absolutely...If as per FIR crime has been committed at 'Y' and 'Z' places then the Trial can take place only at either of the Y or Z. though FIR can be lodged at any place.Magistrate at 'X' place has no Jurisdiction to try the case,it is barred by 'Act of Limitations' on Jurisdiction.The landmark Judgenment in this case is Y.Abraham Ajith & Ors.VS.Inspector of Police,Chennai.

I am citing you 4 Citations of Hon'bl S.C and 11 various Hon'bl High Courts which will be of immense help to you to ask for Quash[u/s.482 of Crpc. with Hon'bl H.C and if charge has not been framed then Discharge u/s.239 of Crpc from the Ld.Magistrate] or transfer of the case from place X to place Y/Z.Note both the places Y and Z have jurisdiction.
