Shortlisting of sc candidate under ur category but given post under sc category in final merit

If an SC category candidate is shortlisted for an interview under the UR list through a cutoff based on GATE Score and given an interview for the recruitment process, he will be considered for that particular post in the UR category or SC category in the final merit list. 

Is there any legal provision where such an SC candidate can be selected either under UR or SC category based on the final cut off for the final merit list that benefits them most and to fill the reserved seat / Unreserved Seat?

If you choose as UR then you will be in the general list, and if you choose the reserved category, you will be considered in that category only.

If you have been shortlisted in the general category then it is based on the application and willingness mentioned by you in the application.

You will then be appointed under general category only.

A recruitment agency published a circular having list of candidates who were called for Interview, based on cut off decided by GATE Score/Marks obtained by the candidates. In the said circular they list out candidates as UR (11 shortlisted for interview) and SC (3 shortlisted for interview) for total 4 vacancy (3-UR, 1-SC). Among 11 candidates shortlisted for interview in UR list there was a candidate who actually belong to SC but counted in UR list as he had scored more marks than the cut off for UR at the stage of shortlisting for interview. But after interview when the final result is published, he has been given post in SC category. And moreover, the information about the such SC candidates was neither clearly shown in any circular nor mentioned anywhere else explicitly and kept hidden from other candidates till the time of uploading the final result.

Is the recruitment follows the fair & transparent process? What can be done in this regard?

SC candidate is eligible to be adjusted ingeneral vacancy, if he is in the merti and also if he has availed no concession.

Admittedly, the SC candidate  placed in the UR list while called for interview did not get selected in that category. Still then, he can selected as an SC candidate based on the performance during the interview. It would be unfair if he is denied selection just because of the procedure adopted by the recruitement agency.
