How police proceed for arrest in 498a and dv?

 

 

Wife have taken help of NGO.

 

A Women from NGO is applying all her efforts for compromise and settlement including indirect threats.

 

She is contacting my relatives and creating fear.

 

My queries are:

1) What would be next? I will ensure, I don't get provoke and commit any offence. I will just don't co-operate people of NGO by not receiving their call until I get a legal notice.

 

2) Will I get a call from Police before complaint has been registered?

 

3) Will I get a call from Police after complaint has been registered?

 

4) Will police come to each named person's house for arrest?

 

5) Will it be immediate arrest or I will get a time for AB?

 

Brief details

- Its false allegation. I have explained that its cruelty on husband by wife which includes Physical Harassment.

- A lady from NGO has not given copy of complaint to me so that i can apply for AB now.

Please Help.

Dnt fear.

If the FIR is being registered then police will come and took u with them.

so in ur case no FIR is registered.

now if  ur wife has moved to NGO then just relax and ask them to do what is legal for our case.

now if they treat u indirectly record thier threat and keep it with u as a proof.

now here come the case

If the case or FIR been registered then police will come and arrest u.

U are husband so generally AB is not granted for u.

better surrent in local court and apply or regular bail and then fight case.

answers for other questns:-

2) it depend upon police that they call u or not

3)same as above answered

police in some cases come and took the person named in the FIR to police station and leaves then by judging the truthness of complaint(bt remember it is outside the authority and also they may not leave such situation as it is golden chance for them to earn some hush money).

4)arrest can immediate also or can be delay if u have some people known in police or if u r influential person.other member of fa,ily will easily get AB so if U get to know that FIR is made agaist them just ask them to be underground untill AB is granted

5)same as answered above.

arrange AB for ur parent by this way u can save them from getting arrested. now police behavior also depend from police to police,they may or may not,Its better to cooperate with them till u are presented before the court. If police ask u anything then politely say that U havnt done anything, bt I dnt thnk that they will treat u like criminal. also they dnt ask u to sign any document and if they then read it carefully and then decide weather to sign it or not.

nothing wil, happen weather u sign or not,

let's  take another case-

for eg police arrested a person and asked him to sign a paper in which it is written that u have done this this crime bla bla etc etc.

and the person in fear signed the paper,then also if he rejects in court that police have ill-treated and forced him to sign that paper then nothing will happen,

Agar paper sign karane se sab kuch ho jata to ye police wale bohut kuch kar lete.
