Contract on stamp paper & registration of document

We have a recruitment consultancy and are about to enter into an agreement with an individual. The individual will be getting commission only if we take his help. For the same type of sale if we don’t take his help he will not get the commission. My Question,

1.       Is it legal to formulate a contract stating the above as a condition?

2.       Do we need the contract to be on a stamp paper in order for it to be legal in Maharashtra, Mumbai. Is a letter head fine?

3.       If a stamp paper is needed in Mumbai, does the stamp paper need to be of Rs. 100 or other amount?

4.       What does it mean by getting a contract registered?

5.       Do we need to get this contract registered even though we have it on a stamp paper?

6.       How many witnesses will we need? Can a relative be a witness?

7.       Do we need to get an affidavit signed by the witness stating that the witness has signed the contract and does this affidavit need to be on a stamp paper? Also, should this affidavit be registered, if yes then where?

8.       If so what denomination stamp paper should the affidavit be on?

9.       Do we need witnesses to sign the affidavit?

A contract for services can be un-stamped, in the form of an MOU with all terms and conditions listed. A contract shall be binding. Include an arbitration clause in case of disputes tomorrow. No witnesses are needed if it is executed between companies under seal. Optionally, you may have one witness (minimum).
