Clarity for rule of gratuity

Dear Sir,

I joined my previous company on 16th Aug, 2010 and resigned on 30th June 2016. I have completed 5 years 10 months but my gratuity amount was calculated and given to me of 5 years.

Now I just want to clear whether I should go ahead and claim for 10 months gratuity amount. I want your help sir.

After 5years if employee has worked or more than 6months it shall be counted as 1 year i.e 6years.

Did the employer supply notice of determiantion of Gratuity?

Did you submit FormI?

You may demand to supply,  notice of determiantion of Gratuity, full payment of Gratuity, with interest @10%pa for the delayed period i.e. from LWD.
