Civil suit

 

Dear Sir/Madam,

We seek your kind legal advice regarding a civil dispute with our neighbour.

Our neighbour has recently opened a restaurant facing the roadside. However, he has installed AC vents, exhaust fans, wastewater pipes, and a rainwater pipe towards our side, which is purely a residential area. There is a narrow space of approximately 1–3 feet on our side, provided by our landlord only for ventilation purposes.

Despite repeated objections, the restaurant owner has forcefully installed these systems facing our windows, causing continuous nuisance, including excessive heat, foul smell, noise, and unhygienic conditions. Recently, he has also installed a rainwater pipe towards our side, which may damage our property in the future. We also apprehend that he may install 7–8 more AC outdoor units facing our residence.

We have already approached the court through an advocate, but unfortunately, no effective relief has been granted so far.

In this situation, we humbly request your guidance on the following:

  1. What legal remedies are available to stop this nuisance and illegal installation?
  2. Can we file for an injunction or approach any other authority?
  3. Should we consider changing our advocate if the case is not progressing?

We would be grateful for your expert advice at the earliest.

Approach local authorities and civil court with evidences through a local prudent lawyer, if amicable settlement has failed. 

You can change your lawyer at any time, if you have lost faith in him / her.

You have already approached court for relief and remedy, of course it is not known that what was suit filed before civil court,  but you need to wait for the court to pass orders after full trial 

Until and unless your advocate has not conducted your case properly or if he is  found to be incompetent, there is no reason to change the advocate, what if the case is  not progressing despite engaging the service of a new advocate?

Any further opinion/advise rendered without knowing the proper details or background, may be a misguidance.
