Can landowner file complaint under 70 section of karnataka cooperative socities act before registrar

Dear all, Request for help with below query. My land is a part of layout formed by one Housing society registered under Karnataka Cooperative socities act. Land was given to society thru GPA to develop and form a layout. It has come to my knowledge that, my land usage as per the sanctioned plan issued by Authority should be used for formation of some portion for formation of 40 feet road and Major portion for park along with adacent properties. However the society has made sites in Park and sold to its members violating the sanctioned plan. Also someone else property is also sold with mention of my property no. Also some sites are sold to bogus members of society enrolled as associate members. Can land owner can file complaint before the Additional Registrar of cooperative socities under Section 70 or under any other section of Karnataka Coperative socitey act for misuse of land by both socitiey and its members for cancellation of sale deeds. The land owners can invoke  section 70 of Karnataka Societies act in limited circumstances but not in general disputes. 

Section 70 applies to disputes “touching the constitution, management or business of a co-operative society” between the society and its members / past members and persons claiming through members or the society and any person with whom it has business transactions. 

In the WP 11346 of 2021 the High Court held:

The Additional Registrar of Co-operative Societies (ARCS) has power under Section 70 to:

examine legality of allotments, cancel allotments and even registered sale deeds, if they are contrary to sanctioned plans, bye-laws, or statutory requirements.

This includes illegal conversion of parks / civic amenity areas, allotment to bogus or ineligible members and manipulation of land details and site numbers, and also that the registration of a sale deed does NOT protect an illegal transaction.

You can make a complaint to the (BDA / BMRDA / Local Authority) for violation of sanctioned plan and Park encroachment.

You may consult an advocate having expertise in the field and proceed as advised.
