Call from police station

Mr.Chandrashekar Joshi, nothing to worry. Just to scare you, the OP ( Opposite Party ), might have made a person known to him at the police station, call you. Even if there is a written complaint, you go and tell them you want to give a counter complaint against him. They will ask him to give a reply to your counter complaint and ask you to give a reply to his complaint, in writing. In fact you can send your complaint against him by regd post ack due to the inspector of police. Then the same procedure happens. Nothing to worry about. Record any such phone call and communication and continue normal life. Even if they visit you, ask them to send a notice. Once notice received, reply to notice within 3 days and again same procedure. Just don't worry. Continue normal life

The police offical may listen to both sides, on verbal complaint and close the matter verbally.

In case of proper complaint the police official may call or even send police constable with Parwaana.

You have not at all stated what are the facts.

 

Police do show the coutesy of calling person by phone call.  Need not provoke them.

You are either yourself not aware of the facts or do not want to share and want this froum to tell you whether the matter is serious or not.  You are not so simple as you pretend to be.  You might be aware who has made complaint and what complaint is made and wheter the complaint is true or false.

 

You have to be absolutely clear :-

 

  1. YES POLICE CAN CALL ANYONE TO POLICE STATION.  They have powers under CrPC to call anyonw by written notice (which you want to compel them) and make him sit there for whole and can get undertaking to come next date.
  2. SUCH NOTICE if invited by you will be brought by a constanble in uniform asking for your address.
  3. DEFIANCE OF SUCH NOTICE is itself a crime and a seperate FIR can be registered which they do not do unless badly copmpelled by the called person.
  4. They can  call you even if they have registered NO FIR AGAINST you on the pertext of knowing facts whether any case is made out of (against you or anyhone else) not or whether any leniency is to be shown or not.
  5. If you want a copy of the complaint from IO he will refuse.  You are only entitled to copy of the FIR if/when regisered aginst you.
  6. You may take it under RTI after one month (or may be more) .

All points fine.

point (5)...usually they give it there to see and read...photo-copy if required, only then, the challaan payment and formally 

copy of the complaint to the party seeking it.

point (6) RTI, why one month ? Is there a waiting time ? I guess NO.

An accused has a right to get copy of the complaint as part of evidence only when he is charged in court.

 

When RTI application is given to any govt authroity he has a licence not to respond till one month as fine @Rs250/- permonth starts thereafterr (which is never awarded to the victim).

 

One month time given to police is more than sufficient to display malice
