It is difficult to comment on the matter without knowing the detail under which terms and conditions the Corpus was deposited in the first place, in some cases the Builders may have retain the right to use the Corpus for some specific purposes or there could be instances where some other apartment owner have not paid maintenance charges and the builder has adjusted the shortfall form the corpus. As I said more information is required for give an opinion on this
