Builder not registering the property

I live in Mumbai and we paid for a flat 1.9 years ago in Meera Road. We have a letter of allotment given to us stating the details of the payments made in cheque towards the flat with the receipts.

However, there has been no development in the building and for the last 1.9 years there is not even a floor built.

The builder is now not ready to register the flat. We have made multiple follow-ups with him, but he keeps ignoring this process.

I want to know:

1)    1) Can I file a law suit against the builder in the consumer court to get him to register the property in our name?

2)      2) Since he does not want to register the flat, how can we refund the money back?

 Can someone please guide me in this process?

Refer to the agreement. What is the time limit in the agreement.

 

If the buyer has exceeded the said time limit then you can surrender the flat and file a case and seek compensation too
