Bayana amount.

I entered into an agreement to purchase a plot and then to construct the house by paying total of Rs.200000/-in which Rs. 50000/- is entered as registered Bayana signed by the Tehsildar. Now my bank has refused to sanction the loan for that part of land with the objection that the land is cleared from the Town & Planning department and is not approved area. The registered Bayana is the main requirement to apply for the Loan amount after that the legal report is submitted by the lawyer. Now how can i get my amount back given as the Bayana because it was nott earlier told to me that the land is not cleared from the Town And Planning Department.
