Bail

Hi,

One of my close relative is a goverment servant and an FIR is filed against him  in the month of January under section 420 and section related to fabrication of documents which was not true.It was related to a civil construction work.His Anticipatory Bail was rejected in lower court and high court. Now my laweyer is saying three options are available..

1. Applying in Supreme Court

2. Surrending in Lower Court and getting Genral Bail

3.Waiting for 90 days so that police can file chargesheet and then bail can be taken

 

Please guide me which option wiill be most suitable as our first priority is he dont stay in custody a single day.

Also throw light in what condition bail will be given after 90 days!\

you may advise your friends again move for anticipatory bail under section 438 of CrPC in the High Court mentioning changed circumstance
