Dear sirs,
I have purchased a flat in 2007, from a seller who has bought the flat throughan auction from the bank in 2006 with registered documents and through HDFC. The auction was carried on thebasis that, the Mortgage has given a consent to the bank, for taking possesion of flat in case of any default in payment by him. Now i got a notice from the mortgage that, iam staying illegaly on the flat and asking me to vacate. Iam paying all taxes on my name from 2007 onwards. Kindly advise me, whether the mortgage hs right to do such act and what are all the legal issues on it. please.
